Understanding Drug Paraphernalia Charges in IL
Drug paraphernalia a broad term used to describe any implement used in the manufacturing, preparing, using, or concealing of any illicit drug whether it is marijuana, cocaine, crack, heroin, methamphetamine or any other drug. This includes:
- Bongs
- Roaches/roach clips
- Needles
- Crack pipes
- Scales
- Spoons
- Balloons/baggies
- Whip-its
The list of objects consider drug paraphernalia in Illinois statute is not exhaustive, and an argument can be made to classify any object used or intended to be used with illegal drugs as drug paraphernalia.
Most drug paraphernalia charges are classified as Class A misdemeanors. Convictions on these charges can result in a sentence of up to a year in jail and up to $2,500. In many cases, however, lesser sentences and probation are possible with proper representation. When drug paraphernalia charges are filed in conjunction with other drug charges such as drug possession or drug manufacturing, however, the sentences can be far more severe.
