Understanding Burglary Charges in Illinois
A burglary conviction carries harsh penalties, so our attorneys will research your case to establish whether a burglary actually occurred. According to 720 ILCS (Illinois Compiled Statute) 5/19-1, a person commits burglary when without authority he or she knowingly enters or remains in a building, trailer home, watercraft, aircraft, motor vehicle, railroad car, or any part thereof, with intent to commit a felony or theft. In simple terms, under Illinois law, the intent to steal must be proven before it can be considered a burglary.
Burglary is considered a Class 2 felony, and is punishable by three to seven years in prison and up to $25,000 in fines. In some cases, depending on where the alleged crime was committed, burglary can be a Class 1 felony, which carries tougher penalties than a Class 2 felony.
