Avoiding Summary Suspension
In Illinois, drivers who are arrested for a DUI must surrender their driver’s license at the time of their arrest. You are allowed to continue driving, however, until your license is officially suspended 46 days after your arrest. This is called a statutory summary suspension. A summary suspension can be contested with the Secretary of State if a petition is filed within 90 days of the notice of summary suspension. A hearing is then scheduled to hear the facts of the case. At Ramsell & Kunowski, L.L.C., our attorneys are extensively experienced in handling these types of Secretary of State hearings and presenting effective, proactive defense cases on behalf of our clients.
